What Is Lis Pendens? Why It Matters in Pinellas County

Lis Pendens is Latin for “suit pending.” In Florida’s judicial foreclosure system, it’s the public notice your lender files with the Pinellas County Clerk to alert everyone that a lawsuit involving your property is underway. Once recorded, it can restrict your ability to sell or refinance without addressing the lender’s claim—and it signals that the foreclosure clock is moving.

What a Lis Pendens Does

  • Public notice: Tells the world (buyers, title companies, other creditors) there’s a claim against the property.
  • Cloud on title: Any sale must deal with the lender’s interest—typically through payoff, reinstatement, or an approved short sale.
  • Timeline pressure: The case proceeds in court toward judgment and a potential auction if no resolution is reached.

Your Options After Filing

  • Reinstate or modify: Bring payments current or apply for a loan workout with the servicer.
  • Sell with equity: If value covers debt + costs, a standard sale can stop the case.
  • Short sale: If underwater, list the home and submit a complete short sale package for lender approval.

If you were renting in Pinellas County during Hurricanes Idalia, Helene, or Milton, you may qualify for up to $80,000 in homebuyer assistance.

Pinellas County launched this program to help storm-impacted residents transition from renting to owning. The assistance can help cover:

 

  • Up to 100% of required down payment

  • Reasonable closing costs

  • Mortgage financing support

 

The program is available to income-eligible renters who do not currently own another home and can qualify for a 30-year fixed-rate mortgage.

⚠️ Applications are processed on a first-come, first-processed basis. Once funds are committed, the program pauses.

Pinellas County created this Homebuyer Assistance Program to help storm-impacted renters transition into homeownership.

What the Program Covers

Eligible buyers may receive assistance for:

 

  • Up to 100% of required down payment

  • Reasonable closing costs

  • Mortgage financing support

  • Subsidized interest or principal

 

Who May Qualify

You may be eligible if you:

 

  • Lived in Pinellas County during the hurricanes (excluding City of St. Petersburg)

  • Do not currently own another home

  • Have household income up to 120% of Area Median Income

  • Can qualify for a 30-year fixed-rate mortgage

 

Income Examples (120% AMI)

1 person – $87,600

2 people – $100,150

4 people – $125,150

 

How the Assistance Works

  • Maximum award: $80,000

  • Structured as a forgivable 5-year loan

  • 20% forgiven each year

  • No monthly payments required

  • Must occupy the home as primary residence
