Company position is that harassment is a form of misconduct that undermines the integrity of the employment relationship. All employees have the right to work in an environment free from all forms of discrimination and conduct which can be considered harassing, coercive, or disruptive, including sexual harassment. Anyone engaging in harassing conduct will be subject to discipline, ranging from a warning to termination.

 

Capstone has adopted, and its policy is based on, the definition of sexual harassment as set forth by the Equal  Employment Opportunity Commission (EEOC). The EEOC defines sexual harassment as unwelcome advancement, requests for sexual favors, and other verbal; or physical conduct of a sexual nature when:

 

  • Submission to such conduct is made either explicitly or implicitly a term or condition of your employment.
  • Submission to or rejection of such conduct is used as the basis for employment decisions that affect you.
  • Such conduct has the purpose or effect of unreasonably interfering with your work performance or creating an intimidating, hostile or offensive work environment.

Sexual harassment does not refer to occasional compliments of a socially acceptable nature. It refers to behavior that is not welcome, that is personally offensive, that debilitates morale, and that which interferes with work effectiveness.

 

If you feel that you have been the recipient of any type of discriminatory or harassing behavior, report it immediately to your supervisor, any Executive or the Director of Inspections & Reports (I&R), which can easily be identified by looking at the posted company organizational chart. It is preferable to make the report in writing; you can always accompany or follow up your written report with a verbal report.

 

if your supervisor is the source of the harassing conduct, report the behavior to that person’s boss or the Department of I&R. Your identity will be protected whenever possible and your position at the company will not be compromised in any way by filing a report.

 

The Department of Inspections & Reports will investigate the complaint. A Manager will speak to possible witnesses and persons named in your report. Depending on the complexity of the investigation, you should be contacted shortly about the status of your report and what action is being taken.

 

Capstone will permit no employment-based retaliation against anyone who brings a report of harassment or who speaks as a witness in an investigation.

 

Discrimination or harassment will not be tolerated at Capstone. If an investigation of any allegation reveals that harassment behavior has taken place, the harasser will be subject to a disciplinary action.

 

Disciplinary action available to the company includes but is not limited to:

  •  Written Warnings
  • Suspensions
  • Terminations
  • Legal Prosecution
